Terms & Conditions

These Terms and Conditions ("Terms") constitute a legally binding End User License Agreement ("EULA") between you ("User") and SameAct ("Company") for the use of the SameAct desktop application and associated services.

By downloading, installing, or using SameAct, you agree to be bound by these Terms. If you do not agree, do not use the software.

1. License Grant

Subject to your compliance with these Terms and payment of applicable fees, SameAct grants you a non-exclusive, non-transferable, limited license to install and use the SameAct software on the number of device seats specified in your purchased plan tier.

• Free Trial: A 2-day full-access evaluation license to test the software on your local network.
• Pro Plan License: Usage rights on your Master (Sender) PC and up to the specific number of activated client devices (device seats) purchased, active for the duration of your chosen plan billing period (e.g., 1 Month, 2 Months, 6 Months, or 1 Year).

2. Restrictions

You may not:

• Reverse-engineer, decompile, or disassemble the software
• Redistribute, resell, or sublicense SameAct or any portion thereof
• Use SameAct to access or control devices without the explicit consent of the device owner or authorized administrator
• Use the software for any illegal, unauthorized, or malicious purpose
• Remove or obscure any proprietary notices or branding from the software

3. Intended Use & User Responsibilities

SameAct is designed for use by IT administrators, computer lab managers, and authorized network administrators who have full administrative rights over the devices they manage. You are solely responsible for:

• Ensuring you have proper authorization to manage and control each Receiver device
• Complying with all applicable local laws regarding remote access and monitoring
• Obtaining informed consent from users of Receiver devices where required by law
• Configuring firewall and network security settings appropriately

4. Intellectual Property

SameAct and all its components, including but not limited to source code, UI design, branding, and documentation, are the exclusive intellectual property of SameAct. These Terms do not transfer any ownership rights to you.

5. Updates & Support

Active Pro Plan License holders receive all software updates released during their purchased active period at no additional cost. Support is provided via email. We reserve the right to modify features in updates without prior notice.

6. Disclaimer of Warranties

SameAct is provided "as is" without warranty of any kind, express or implied. We do not warrant that the software will be error-free, uninterrupted, or compatible with every system configuration.

7. Limitation of Liability

To the maximum extent permitted by applicable law, SameAct shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the software, even if we have been advised of the possibility of such damages.

8. Termination

This license is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the software and destroy all copies.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
